Active corruption occurs only when an official or other servant is intended to obtain gifts or other advantages in order to commit a criminal offence, contrary to his duty. Passive bribery, on the other hand, consists in the personal acceptance of gifts or other benefits of monetary value for future official acts, whether or not in breach of duty.
